fencing against my boundary sheds
Anonymous user 09/03/2024 - 2.51 PM
A new planning application has been made for a house behind my garden. On the boundary line i have some outbuildings (timber framed sheds with corrugated metal cladding) . The proposed house shows wooden fencing right against the boundary, ie the walls of these sheds. So if this was done i could not maintain the external walls of the buildings. Can they get approval for this?

The question I would ask you is how did you maintain the fences before the proposed fence?
Was your shed wall effectively the fence?
Perhaps the owner would allow your sheds to be the fence and to allow you access now and then to paint the sheds.I would try to have a word about this with him on a face to face basis to see if he would allow this because unless there is some restrictive covenant on the land or local planning restriction which prevents the erection of fences
or controls their design and style as might be found in a conservation area for example, then he is entitled to erect a fence within his boundary to a height as prescribed in the local plan .
A lot of people make this mistake and do this sort of thing without considering what would happen if someone should build on the boundary.
It sounds like you have been caught out here so best to try to sort this out over a cup of tea.

Presumably there will be proposed excavations and foundations associated with these works. Have you consulted a Party Wall Surveyor to establish if this developer ought to be serving you a Party Wall Notice prior to the commencement of the works ?
I hope any discussions with a Party Wall Surveyor can help resolve and clarify this matter for you.
