Toilet plumbing in block of flats - building regulation

Hello, in follow-up to my earlier question, I can confirm that there is a toilet plumbed onto the 3-inch waste pipe at the upper storeys in our 1890's converted block of flats (2 different plumbers confirmed the same). As result, sewerage is pushing up through the shower trays, basins etc. of the flat upstairs from me, and eventually flooding onto my ceiling. A pipe also burst. We have had 2 incidents like this in the lasts four months. The first incident left my flat and the upstairs flat uninhabitable for 2 months, with an enormous bill to replace the ceiling etc. How can I get the owner of the flat with the badly plumbed toilet to fix this? He has so far refused, and our block management won't take responsibility. Is there for example a building regulation that stipulates a toilet cannot be plumbed onto a 3-inch waste pipe in a block of flats? What recourse or protection do I have to stop this from happening again? The flat is in England. Any suggestions highly appreciated.

where are you ?,environmental health department and building control both can get involved in this,get together with any other flats affected all complain to environmental health officers at you local council they have powers to rectify this.if you get building control to look at it and confirm that not plumbed in properly you could all sue the flat holder responsible.
