Tiling

client canceled our agreement and now wants compensation

Anonymous user 09/03/2024 - 2.50 PM

Hello, I have done this job for almost 4 years without any complain and with a lot of happy customers. I have made and signed an agreement with a private person for kitchen floor tiling, bathroom and cloakroom tiling just for labour because he said he will provide all the materials I have started work but the materials were not in time and he made me do a lot of extra works which were not included in the agreement because the materials provided were the cheapest ones on the market. He paid me half of the money which we initially agreed and with two days before i finish called and said he is not happy with my works and he wants to terminate the agreement and asked me to return the key . I was agree because i am not a fighting person. He then sent me an email saying that we were commonly agreed to terminate the agreement and the balance is cleared to 0. Because i dont have the time or energy to fight over this i was agree and took it like a lesson even if i lost half of the money. After two days they called me and gave me a lot of reasons that they dont like what i did and they will need to redone everything and they want compensations for everything they paid (labour and materials). I know that i have did all my best to do a good work. I dont know what to do ....

Tell your ex clients to go and do one. Or take you to court don't think they would win.

Hi, Sounds like you've both agreed to end the initial contract only. The extra work was not agreed within the initial quote, so you're well within your rights to argue that when you agreed that the balance owed was £0 due to the early cancellation, this was only in regards to the initial agreement and not the additional work. I'd send your customer an invoice for the additional work. Regarding their claim for compensation, let them try and take you to court. If you've done a decent job they won't have a claim. In future make sure you photograph your work before and after. It doesn't happen often, but I've had a couple of issues with payment in the past, but it soon sorts itself out when you're the one threatening to take it further and providing evidence that you did a good job.
