Legal responsibility of contractor

Anonymous user 15/03/2024 - 2.35 PM

Earlier this year I engaged a landscape garden company to make over my front garden, including the planting of a privet hedge. The work was completed 3 months ago. In the last couple of weeks I noticed that horse tail was growing from the root ball of first one, then two, then three of the privet plants. I fear all the plants (35 of them ) might be affected. I have emailed the company to tell them and complain but have received no response. What are my rights in this situation and what responsibility does the company to rectify what could be a developing disaster?

Are you a tradesperson and able to answer this question?

Horsetail is quite invasive and should be removed as soon as possible, in this case. Whether your contractor was responsible for introducing it would be very difficult to show. It may be that you are right in assuming your contractor's responsibility here. However proving it and persuading the company to rectify will likely be very troublesome for you. It may be best to take over the project yourself, perhaps even hiring somebody else to weed out the deep roots of the horsetail. Either way, don't delay. Good luck.
