Share of Freehold party wall agreement

Hi We are looking to build a side return extension. We live in a Victorian mid terrace house. We are the ground floor flat and have a share of freehold with the 1st floor flat. Do we need to issue our upstairs neighbour with a party wall agreement for a single storey side return extension? Thanks

Hello,yes you will need to issue a party wall agreement,if you are removing part of your original wall that is shared with your upstairs neighbour it will cover any damage to your neighbours flat and they can check that the correct steels are being installed.
