Extra to above question his fence is on his poperty not on ours but he put it up onhis drive leaving his boundry and ? Land on on our side of his fence. We knew nothing about boundry until today after work had been finished he accused us of building on his land . We have only done things on our drive not touching his fence .

Hello ..
As this is His fence on his land then the land on his deed lines still belong to him .even if he has not gone to the exact boundaries with the new fence
The lad up to your boundaries is still his .as long as he maintains it fully.
If he has moved on to your land with the new fence.
The land still belongs to you.just the same

Check your deeds, they will have your boundary lines on them and any other boundary considerations. If he has moved his fence inside his boundary the boundary on the deeds remains.
If an encroachment has occurred then you might need to talk to a solicitor about how to resolve any issues.
