We have blockpaved our driveway and put a new shed up . We have left a small gap up to HIS fence as ordered by our neighbour as he said we were building on his land . As far as im aware the fence has been up approx 15 yrs . We inherited the house 8yrs ago .

Check the land registry/deed plans to see where the boundries lie.
Boundries are sometimes difficult to conclude with a neighbour, so it is best to get a solicitor to verify documents and they will contact your neighbour in writing to advise of their findings. If they are erecting a fence on your land they will be instructed to remove it by your solicitor within a set timescale.

The only real answer to this is in your property deeds.
Get a copy of these and suggest he does too and then compare them to make sure they say the same thing. If they don't you need to then talk to the Land Registry who should have the definitive version.
If they don't, they will advise you what to do from there.
