Neighbour has windows on the side of extension.

We have recently moved into a terraced house and the neighbour has built a rear extension with windows on the side. They are relatively small rectangular windows at a high level with obscure glass in. We are looking to build our own extension but would need to build close to these windows. Surely the fact they have decided to put side windows on a terraced house extension should not impact our building work?
Are you a tradesperson and able to answer this question?

I would discuss this with your local authority planning as it is unlikely that the side windows were approved and may be in contradictory to their agreement for planning permission.

Side windows are permitted under the general permitted development order if they are obscured and non opening. If your permitted development rights are in tack you could extend your house. If you are building within 3 or 6 meters of a neighbours structure you are required to serve notice under the party wall etc act.
