Wooden staircase nosing - flush fit or raised?

What is the most appropriate method for fitting the nosings that are part of a wooden staircase-cladding kit? Should the nosings be flush-fitted to match the level of the tread, or are they raised from the tread? The going is 20.5cm in length. If one method is better than the other, is that simply a common practice, or are there also some building regulations in play? For context - I am having a dispute with a builder who did some renovation works for me earlier. This is one of the issues under dispute: the builder had cladded half of the staircase with raised nosings, claiming that this method is considered safer. After discussions with various other builders I had the cladding refitted later, with the flush fit. When bringing this up with the original builder he has said that my new hire had been just desperate for work and taking advantage of my lack of knowledge. Any unbiased and independent feedback on this would be most welcome.

Wooden staircase nosing shut be defenatly flush fit.

Flush, no question. Raised is a trip hazard, on stairs! get rid, If the builder has allowed that sort of work what else have they done wrong!
