At risk boiler installed in garden shef

Neighbours have a outside swimming pool boiler for it is in shed in garden old flue vented through the top of shed. New boiler has just been installed with flue through back of shed 1 inch away from the top of Fence which we own at face height to us when standing next to it. Next to our seating area it is not sealed at all and produces very very hot air which would burn you so we can no longer use the seating area. The noise is horrendous and the plumes are so bad and it's the summer so will be awrful in winter also it's going to cause major damage to our fence. Never had any issues before but causing major problems. A flue management system will not cure it as it would be all on my side of the fence. Neighbour told gas fitter to put it there as she didn't want the hot steam on her side. Also it will be on all year round. A gas fitter independent one came and looked from our garden and said its illegal and at risk. Where do I go from here rules and regulations for exterior boilers and flues in gardens in wooden sheds please would really like advise. Real safety issue. Thank you Would love to post photos so you can see and then give me your opinion but don't know how to do it ?? Contacted the number you gave they say if it's that close it's appalling and fitters should be struck off if they are registered. Contacted local council with lots of photos and videos environmental dept have passed to building control awaiting reply. Thank you

First port of call is Gas Safe: Tel 0800 408 5500 As you have not stated whether it is a Gas or Oil fired appliance, I have assumed its Gas. State the facts to them that were reported to you by the Gas Safe engineer. If he has deemed the installation as 'at risk' then he has a duty to issue your neighbour with a safety notice whether they accept it or not!
