Possible soakaway, new guttering and boiler overflow.

I have a mid terrace house without any down pipes. The intention is the water runs down the row from house to house and drains at the end. however it's constantly overflowing and dripping on us and has caused some damp in the wall between ours and our neighbours property. I would like a down pipe fitted to take some of this water away and reduce the risk of overflow. The house currently has a gravelled area between the drive and the house presumably for drainage. We also have a vertical plastic pipe sunk into the gravelled area and concreted bin, which is of downpipe size. Currently it's used for the boiler overflow. This pipe seems to have a fixed level of water in it, which implies to me that it is a soak away which sits at ground water level. I poured hose water into it and it filled up then drained away. Can I fix a new downpipe to this vertical possible soakaway?
