Side Hung to Top Hung

Can a Side hung window be changed to a Top Hung window after it has been installed or do I need to replace the full unit? The council will not sign my completion document for my extension until this widow changes for building regulations. I had been told by the builder that this met the requirements but have since been informed by the inspector who has come to carry out a final inspection post electrician that it doesn't meet regulations for a fire escape.
Are you a tradesperson and able to answer this question?

Unless the sash is of equal width and height no. New sashes would be required

new sashes would be required unless as previously said the sash is equal height and width then there will only be a few small holes in the sash from the hinge movement.
