Should there be an air brick at floor level in a new chimney?

We bought a new build 18 months ago ( NHBC covered) & it came with a chimney / class A flu that was suitable, we were told, for a solid fuel fire. The builders covered up the bottom of the chimney with plaster board incase we didn't want to open it up. We soon had a fireplace professionally installed. My question is should there be an air brick at floor level as i have doubts about the amount of the 'draw'. I try not to overload the modest basket but smoke sometimes escapes into the room & when the fire is almost out fumes seem to leak into the room from the coal embers. Even if we open the trickle vents on the windows the smoke still sneaks into the room. We only use the fire at weekends in the winter evenings. Cant believe the chimney needs cleaning. Any advise would be appreciated. If the builders put a flu in are they duty bound to make sure the draw is sufficient ? Many thanks
