Do we need to get permission to replace our conservatory roof?

We have a conservatory that is adjacent to our neighbours taller and longer extension. We have a plastic roof at the moment and want to replace it with glass. Our neighbour claims we need her consent in writing to do any work to the roof claiming the 'party walls act' (she sent me this link: https://www.gov.uk/party-wall-etc-act-1996-guidance). Being that we're only replacing what is already there and not changing the size or shape of the structure, is this really necessary? The flashing from her roof does overlap onto ours but obviously we will leave this as is. She's a very difficult neighbour and i think she is just throwing her weight around but would appreciate some advice.

If you are replacing the roof with the same style, all be it glass style, I would say you don't need any permission. A phone call to your local planning office maybe a safe bet. Only problem maybe access for the work if you need to go on your neighbours side. Pete

Do you have an existing party wall agreement? Probably from when your neighbours extension was built? If so she's probably in breach of this if her extension flashings project over the boundary line, could be useful ammunition for you. Conservatories are not subject to planning permission as they are considered "temporary constructions" I see no reason why you cannot simply replace what is there. Your planning office should confirm this. Paul.
