2 mt concert post, 4' fence & 2' tressel ,3' from my side windows no fence was before a side fence ?

between me and my next doors house is approx 17' this used to be an very old drive way to a manor house that was destoryed many years ago, my house was built on the footings of the old gate keepers house hence the extra wide area between our 2 houses, there has never been a fence bewteen us before, but out of the blue and without telling me i found my new next door hacking at the large bushes he then told me he was putting up a new 2 metre fence and down the side by my stain glass windows a 4' fence, which although this side is my boundry he was going to put it on his side , i said that was fine as long as nothing went over my stain glass windows down the side, the day the fence went in he say the company had made a mistake and no 4' post had been delivered, i said as long as nothing went over my windows i guess the posts could be cut off, however he had laed to me he did it on purpose, that 2meter posts went in a 8" black then a 4' wooden fence followed by a 2' tressels fence, now i have very horrid posts about 2-3 feet from my windows the posts are in line with the windows which you can see all the time , the middle room is darker as this is the only light in the room and if there was a very high wind and the posts were to go over they would go through my windows , i told him that this was not what was promised and he called me a lair about the 4' fence i am disabled and do not know what to do, i now have an ugly view where there was never a fence before the houses are 55 years old now is there anything i can do this is not this first time he has lied to me over something not a very nice neighbour and aggressive. ,

If the fence is on your neighbours boundary I do not think there is much you can do, but seeing as there was no fence before you may have a case. If the fence is touching or is on your boundary you can have it removed immediately but you would need to put in writing to your neighbour to cover yourself. There is also a law called ' Right to light' check this out and see if it covers your issue. By law a fence can only be 6ft max before you need permission from neighbours and I think the council, I would try to find a surveyor do you know one or hire one to see if the boundary has been breached, he has obviously taken advantage of your good nature, if a verbal agreement was made between you both regarding the the fence being 4ft by your windows then he is infact in breach of your verbal agreement any agreement written or verbal is legally binding. You can take him to a small claims court over this breach, check with you citizens advice office for more help. Good luck :)

You say your property is built on the old footprint of a former gate house? Not by chance listed? If it listed it would require planning permission. Failing that, your neighbour can put up a fence up to 2 meters without planning, so check his finished heights. Failing that, you have a 'right to light' (providing your dwelling has been there for 20 years) to sort that one I think you'd first need to contact your local planning department or building control.
