Our neighbour wants to use our external wall as their internal wall

We live in a Victorian house and our neighbor has approached us to use our external wall to extend their kitchen. The gap is probably rough estimate about 3 meters wide. the extension would include a glass roof which will be attached to our roof to enable them to have the extension. However, we are not keen on the idea - if we need to gain access to the wall for maintenance we would only be able to access it from their kitchen and if we need to do major repairs it would affect their kitchen. Also to get access to the top part of the wall would prove very difficult for a builder. Can our neighbors use our wall as their internal wall without our permission?

Hi, I think you'll find that if the outside edge of your wall sits on the boundary line of the two properties or more on the neighbours side then they have the right to utilise that wall as their internal wall. They may however have to sound proof the wall in compliance with the Building Regulations. In order for them to connect their extension to your wall they will need to provide a party wall agreement. They will also need to show that the existing foundation is capable of taking the increased loads from the new roof and the roof light. Hope this helps. Andrew
