How long is too long to build an extension?

Our extension was started in Jan and we were promised that it would be finished well in time for the arrival of our baby on the 5th July and the estimated time of completion was 12 weeks. We are now 8 months into the job and although the shell is up we were left with an incomplete rewire, poor plastering work and no finishing (i.e doors, skirting) for the last 5 months. Our 'builder' apparently had some personal issues which prevented him from being on site and we have had assurances and missed deadlines from March onwards. We have been reasonable and accepted his excuses but my question is how long is too long and what do we do now? We have already paid someone else to finish what we could afford but we still have no kitchen (or appliances), no water supply downstairs and the outside of the build is not sealed or weatherproof. We cannot afford to pay someone else to finish the job nor can we afford to wait till the end of time for the 'builder' to come back. Surely if the builder is struggling financially which we suspect then taking him to court will achieve nothing, do we spend money on the build or spend it on legal costs? Suggestions from anyone welcome. thanks in advance

In response to your last paragraph, did you pay him up front, which i presume you have if you cant afford to pay some one else to finish it, if you didnt kick him off, then if you have over paid him take him to court to get your money back, court cost will be against him not you

This is becoming all too common, how on earth do these guys get work??!! Personal issues my ar*e, he has been doing 15 other jobs at the same time doing the same to them as he has to you. I would wash your hands of him and get the job finished or it will drag on forever along with the misery. In the meantime try to get it well known in and around your area what a rogue he is, ensuring no one else goes through the same thing. These guys just get a slap on the wrist, the only way to stop them is to stop the source of work!

As you seem to realise a lot depends upon the ability of the contractor to repay you for money paid in advance. I am sorry to say that you need a solicitor to advise you and a lot will depend upon the terms and conditions written into any contract you have accepted.
