Do I need my neighbour's consent to make a driveway in my side garden?

I live in a detached house and got a 5yr old disable child...we finally had the approval from disable team to do a ramp in front of my house , I got a big side garden and it is ideal to make it as a driveway for him...but my selfish neighbour don't want to see our car park at the side of our garden because she likes the view of the green grass as she said and now saying we can't make a driveway there...don't know what to do, she is a horrible neighbour even told us that the our front road is actually hers...pls help x now very stress as we wait for a while for my boy to have that ramp for his wheelchair access !!

You do not require her permission for your project but probably need to run things through the council to clear issues over hard standings replacing natural drainage areas. There are ways around this which can be sorted out by speaking with the council.

Hi In response to the question the answer is no!!! as long as that land belongs to you. Providing the surfacing you lay in place of the grass is SUDS compliant then there is nothing the neighbour can say or do. We lay all SUDS compliant surfaces and there is no need for planning permission for these types. Hope this helps Gary Perma Resin Stone

personally you should phone up your local council and ask if planning permission is required, generally it is not as long as its a porous surface, different councils interpret the rules differently so best to ask. building regs or planning would be the best port of call, they will inform you what if anything is required in your area then you can just laugh at the nasty neighbour as your new drive takes shape. good luck Alex

there is nothing your nieghbour can do as long as you are suds complient, that means any new driveway over 5metres square needs planning permission, unless you use a permable material so the water soaks through into your own propery, or you install a soakaway area with a drainage channel at the end of the drive running into it, that way you are completely above board and legal
