gardening job not finished but paid full amount

I had gardeners start my garden over 3 months ago to do a 3 week job in all its cost me £6000. I've not received no paper work when asked to see how much materials had come to. All I got told was my gardeners old employer has them. The garden is not to standard I would say for £6000. He keeps telling he will come finish the job but does not. There is still slabs to be laid and a main fence to be fixed which he has broke while doing my garden so now my garden is unsecure as my dog now gets out through the broken fence along with my children. There is slabs not put down properly either and wonder where I stand as I have already paid the money and have been messed around with from day 1.

Simply a matter for the small claims court. Very easy, log on to your local court download file and explain your circumstance. Just so you know by law you are required to allow the contractor a chance to come back and put right, this of course should be done at their expense, serve them a letter now stating that you give them 14 days to come back to you with a proposal for remedial and finishing works. Failure to respond within 14 days you simply start the proceedings, remember to close your letter to them stating you will be taking court proceedings if an agreement is not reached. You must keep copies of everything, it does not matter if you do not have a written quote, some people still agree jobs verbally on a handshake with no paperwork, this is still a binding contract and as an agreement had been made. He is in breach of contract, do not terminate the contract without issuing him a letter first notifying him that you are terminating. Now go take this cowboy to your local court its a very easy painless process. Paul

I am not sure why you have paid up front for the works, but if you have his address I would say put everything down in writing that still needs to be done. Send this to him saying he has 14 days to complete the works or you will employ someone else to complete the job and then seek the cost from him through the courts if required. Next time make sure you get at least 3 quotes in writing explaining exactly what is to be done and how much the job will cost. Stage payments are ok as long as you are paying for work that has been done or materials that are on site but you should never pay in full until the work is complete.

It sounds like he is a cowboy. I’d refuse him to continue any work if he returns and take the case to the small claims court. I am so sorry this has happened to You.

Hello there, You should have seen his work and have asked for credentials. Never pay anything upfront until the job is finished and you are 💯 satisfied. Always ask for quotation and a clear description of the jobs needs to be done. No matter how small the job is always ask for a document (quotation). Which can always be helpful if anything goes wrong. It’s sad to hear that traders do such a thing which always puts a bad image out there and it ends up affecting others.
