Electrician failed to provide Part P certificate for new consumer unit

4 years ago a NICEIC registered electrician fitted a new consumer unit at my property. Despite contacting him numerous times in the following 9 months by phone and letter, he failed to provide the certificates each time giving excuses ie my computer crashed, i've got behind with my paperwork but will shortly be employing help, I will do it after christmas and on and on, eventually not knowing what to do foolishly gave up. I am now selling my property and a part p certificate is required to satisfy solicitors. What can I do?

I am a registered electrician and would like to add, I feel sorry for a lot of householders/small builders who get bamboozled with what they should do, or should have done, why when people get their electric bills/gas bill don't they have the regulations on the back with all relevant information on it? We all know we have to insure tax and mot our cars, why is that? Education and the police behind you if you don't. Also why doesn't a job need to be registered before any work takes place, with an intent to do notification? That way the installer could not proceed without it and so a copy of registration and insurance would be with the customer prior to any works taking place, thus protecting them from cowboys. Even now after years of part p, most householders have no idea about it, only reputable builders ask for my registration,and even then take my word for it. Electrical wholesalers and other shops that sell electrical materials that when installed need part p, shouldn't be able to sell this stuff to anyone other than registered electricians with a part p card, no card no gear would help cut these problems down!

Sasha, all too common I'm afraid, as a lot of electricians will claim to be NICEIC registered when they are not or will use a stolen certificates, or fake details, some even to state that are NICEIC registered when working on the side on the basis that they are employed by an NICEIC firm monday to Friday, but that does not count! The main issue is that there is only a window of 14 days from after when the job was completed, to notify building control of the works. As this was never done, technically you as the householder are now in breach of the regulations and could be fined up to £5000. The legal position is that you as the householder must employ a part P registered electrician and ensure that the regulations are met. The only legal way to get a part P building control certificate is to apply for retrospective part P building regulation consent from your local authority. They will probably charge around £300 for this, and then come out and inspect and test the job. If it passes then great. If if fails (i.e. is found to be non compliant with BS7671:2008) then you will have to pay another electrician to put the works right and then pay the local authority for a re-test. Keep all receipts for what you pay out so that you can start legal proceedings to claim this money back from the electrician that left you in this mess. Best of luck, although sorting this out can take months to resolve. Alternatively come clean with the buyer and just knock a couple of grand off the price of the house, so that they can get the house rewired once they move in.

Get it tested by a reputable Electrician. Inform trading standards about the other electrician. Talk to the citizens advice bureau re court order for the price of the new test and anxiety you have suffered. The electrician is bound by the iee wiring regulations, has a duty under the law to ensure by tests the installation is safe and within the parameters set out by the iee. The council must be informed of any part p works undertaken. 2 years in prison and or a £20,000 fine for breaching these guidelines your in a win win situation. So take a deep breath and prepare for battle.
