Who owns fence? Fence was always repaired by the council but now being asked for copies of deeds

Anonymous user 14/03/2024 - 2.33 PM

We own our house but the back fence is in really bad disrepair. The fence covers the whole of the street but backs onto council/ housing partnership property. Having got in touch with council, they sent me to partnership, who now in turn say it is a fence belonging to my road. The nice part of the Fence faces the council property and always has done . I am now being asked for copies of the deeds to my house to determine who the fence belongs to. But in years gone by the fence was always repaired by the council. Very frustrating, annoying and time consuming!!! Any advice would be helpful.

Are you a tradesperson and able to answer this question?

I think the best thing to do would be to look at your deeds

Best way is to look at your deeds to see who it belongs to. In a lot of houses people face the fence out so if you have the rails on your side it might be yours but this is just a guess without looking at the deeds. If you wanted to avoid this and have the fence as your own you could rebuild the fence a little bit onto your land then you can do what you wish to it

Usually the fence has to be replaced like for like as fair as the councils are concerned

You would better off looking at the deeds of your house and finding out whether it belongs to you or not. Fencing is not always included but if the fence that’s damaged is only on your property usually they are replaced by the home owner.

The best thing you can do here is look at the deeds, this will outline to you who owns the fence.
