Damage to property by workman - refuse to repair as ceiling was weak and so not their fault that the damage occurred

Anonymous user 03/03/2024 - 3.08 PM

I have recently had a new boiler installed by a large and well known company and whilst one of the workman was in the loft he either dropped or stood on the ceiling and now there is a crack and severe bowing there. He nipped down and glued it all up and painted over it but there is still damage to the ceiling. I have sent pictures and and asked for a proper repair to the ceiling. Unfortunately there was previous damage to that part of the ceiling which was badly repaired by my father years ago and so the company are refusing to repair it stating the ceiling was weak and so not their fault that the damage occurred. Do i have any redress in this matter ?

You are aware as per your own statement that the ceiling was already damaged and had been badly repaired. You now seem to be asking for the ceiling to be properly repaired which would give you more than you had before by your own statement. Some companys would give this as a gesture of goodwill but no company would be obliged to do so.

they are obliged to fix the damage that they caused , and from what I can understand they have done that . I still think the should've checked the joists in case they were cracked from the impact of the fall and strengthened them which I personally would have done but no one is obliged to give you a new sealing that's for sure.
