Can I use withheld payment for original gardener to pay new gardener?

I had my garden landscaped, the gardener put down artificial turf in two strips one two metre wide and one one metre wide. The artificial turf is different colours and this was highlighted at the time, we withheld a lump sum , there are a few other faults to be rectified, despite emails, texts and voicemails he has not returned my calls or been back since December last year. I have withheld a substantial amount back and I have another gardener ready to do the work, can I use this withheld amount to pay the new gardener?

I would strongly advise you contact trading standards as there advice is free. Many solicitors also offer the first consultation free of charge.

Under no circumstances use that money to pay another contracter keep it untill the case has been dealt with via the courts. I would give him 28 days to put right the mistake and after that if the works have not been completed then send a written letter giving another 28 days if still nothing then court action is the best way.

Give them an email with a time scale to complete the work, if not completed or still no answer by all means I’d go ahead with the work with another contractor, by the sounds of it If he doesn’t want to finish what he started to get his money, then he can’t be bothered with what he has done in all honesty.
