Putting up a fence near the pavement
Anonymous user 14/03/2024 - 2.32 PM
Hi, I live in a corner house and have a bit of land at the side of it. I want to remove our old fence and put a new one up nearer the pavement to increase the size of our back garden for our kids. Would I be able to do this and how far away from the pavement would it legally have to be? There are a few houses near us that have fences right at the edge of the pavement. Would I need planning permission? I wouldn't be blocking the view of the road for cars or anyone's property.
Are you a tradesperson and able to answer this question?

With it being right at the edge of the pavement you can only go up to 1m in height. If 2m or more away from a highway (footpath/road/cycleway etc) then you can go up to 2m in height. Anything outside those rules needs planning permission. Hedges and trees aren't controlled so they may be a better option for you.

The height of any wall or fence on your property can be 1.80 high with out planning as long as it is not in the front garden or the vision splay for traffic going or coming around the corner, just make sure that the property/garden is yours before you move it as normally the fence would go against the pavement when it was put up in the first place
