Neighbour damaging the ground where fence has been erected

Hi, I recently spent £1000 putting up a fence on my boundary. Since then, my neighbour's decided to dig out the concrete posts from the old chain link fence, but in doing so, has dug right up to our fence. As our garden is higher than his, this has caused our garden to start falling into his and we now have big holes all the way along where our dog tries to get into their garden and all the slate we put down is falling through the holes. We have tried talking to him but all we get is "well it's not my fault your garden's higher" he doesn't seem to care that it's him digging too close that's cause it. What can i do?

For a start, if he is digging out old concrete posts along side of your fence, then your fence is in the wrong place. You should have taken out the old concrete posts which would be the boundary line and put your fence back on the same line, it seems you have given him a bit more garden, did you erect the fence yourself or did you get a contractor in to do it? If the latter, get him back and tell him to put it in the right place, a professional fencer would and should have known this. Peter
