Fence encroachment - neighbour has dug holes on my side of boundary

After all the winds recently, the neighbour at the back of the gerden was seen on my side digging holes etc. for concrete fence posts. Later that day, I went down behind my avieries to see what he was doing only to find that he's dug all his holes on my side of the boundary and at one side nearly 2 feet encroachment. I have not seen him since as I believe now that I have taken photos of this, he is waiting until I am at work before getting his work completed. Where do I stand?

He has no right to encroach on your property without your consent, may be if he had asked, you would not have minded. I would suggest you pop a note through his door if you don't want to face them head on and ask them to stop doing any more work on the fence before speaking to you as a matter of courtesy, they have no right to even pinch a millimetre of you ground. We are a professional fencing company and we have walked away from jobs when the client says its ok to take a bit of their neighbour's land without seeing written permission. If they are on your property, just tell them politely get off. The law is on your side, an amicable solution may be agreed with for neighbour which is always better than a long stand feud Regards Peter

The holes and fence should be in correct place incase houses sell new people would not know boundaries and it's common practice and polite
