Reasonable length of time for liability period?

We have planning permission for a single story extension on a detached property. The build will be within 3 metres of our neighbour's property and so we have issued a party wall notice. The neighbour will only sign this if we sign an agreement that we will pay for any damage caused by proposed works... we have viewed his property together and taken photos, and we are happy to sign this, but we would like a defect liability time period set. (We don't want to be liable forever!! If we decide to sell our property in the future, this agreement will go with the sale too!!) My question is what is a reasonable time scale to set for this? We tried 12 months and he is not happy with this. Many thanks in advance of your responses.

The best advice would be to appoint a party wall surveyor who will advise you on the complexities. Your neighbour also has a right to appoint a surveyor at your cost, albeit the most cost effective way is to have the same surveyor. Surveyors are professionals and are deemed to be impartial. It is possible to do things amicably but a party wall agreement is in perpetuity so it's always best to get things done properly.
