Height of fence along boundary

My deeds specify that I must maintain a fence on 2 boundaries between 3 feet minimum and 6 feet maximum. The neighbours garden is about a foot higher than mine. Would the 6 feet maximum be measured from my side, so he only sees 5 feet, or his so he sees 6 feet and I see seven?
Are you a tradesperson and able to answer this question?

Your best choice would be concrete slotted posts concrete gravel board 300 x 1.8 with a 1.8 x 1.8 panel on top,or your panels will rot with your neighbours soil behind them if you dont use a gravel board

Stick with 6' as 7' would be like living in a prison, if you went for seven you would have to put in 6' panels then add a piece or have them specially made
