Leaking foul water coming through kitchen ceiling after bathroom refitted

Dear all,
We recently had our bathroom refitted and since the bathroom was completed we have had a bit of a foul smell in there, but persevered with it. Now we have leaking foul water coming through our kitchen ceiling.
On looking at the toilet, the big foul pipe doesn't look fixed tightly, it looks awkwardly poked into the foul pipe and there are gaps down the big foul pipe. Also the toilet is not fixed to the floor or the wall, there was only silicon fixing it to the wall. I have tried to call our bathroom fitter, but my messages are not returned - any advice would be really appreciated! Many thanks.

You need to get a competent plumber to look at this and rectify the issue as soon as possible as you have a real health issue if foul water from the toilet is coming through the ceiling.
Unfortunately if the original tradesman is not returning your call it sounds like he is fully aware that there was not a very good connection between the pan outlet and the waste outlet. If he is a member of any trade organisation try getting in touch with them as they may be able to help you resolve the issue. Failing that, it would be a case of filing a claim against him in the small claims court - but quite frankly this would likely give you more grief and costs.

Unfortunately, you may have to get the original installer to return to rectify this as it is a health hazard if you have wc waste water leaking. If they will not return, I would advise you to 1). get another plumber in to deal with it, you could claim against house insurance, and claim back from original.
2). Check if the first person is a member of any trades bodies or organisations, and let them know, they will assist in sorting it out. Also he must have Public Liability Insurance he can use for this type of scenario.
