Can anyone tell me why our new larder under counter fridge can not keep uniform temperature throughout the cabinet?

Whilst the temperature on the top shelf of the fridge is correct food on bottom shelf freezes. The engineer who inspected it thought it was a thermostat issue and replaced it but it has made no difference. Can anyone tell me what the problem is?

it could be the door seal.or if not that, then is a fault with the refrigerant charge.
