Chimney & Fireplace

My neighbour has disrupted the stability of my chimney whilst re-roofing his house

Anonymous user 03/03/2024 - 3.00 PM

I live in a terraced house and my neighbour has been renovating his. He has put a 2-storey extension on the back but whilst working on the front of his house he found rot in his ceiling joists and rafters and has had to completely remove his roof. Whilst doing this, he decided to remove his chimney stack which is attached to ours. When he started to remove his stack (without our consent) he has exposed one side of our chimney stack which has caused the whole chimney to be unstable and is now a safety risk (our houses are extremely old). He says the our chimney was already unstable and so all he needs to do is carry on removing his chimney stack then make ours watertight and render over, but it is not up to him to make it stable. Can anyone help with any advice? We don't have a party wall agreement, I can't prove that my chimney stack was stable however we use the fire and have done for 6 years with no problems and have had it swept with no issues. Since he started we have had soot fall and bits of brick etc keep falling down the chimney into the fireplace?

First port of call should be your local council building regs, as it must be signed off by them to say it is safe, secondly he should not have started any work without having a party wall agreement in force. The fact that there are now bits of brick falling down your chimney where as before there was not, tells me it is his work that has destabilized this shared chimney. Your chimney sweep can confirm there were no problems when he last swept it. You do not say if it is in a conservation area or if it is listed, if it is this will also need planning consent and listing consent (English heritage) Good luck
