Roofer installed neighbours tiles onto our property

Anonymous user 28/02/2024 - 2.57 PM

Our neighbour had his tiles replaced on his main roof and on a small extension that all the terrace houses have at the rear. His roofer cemented a hip onto our property (a new flat roof extension) and broke 2 of our tiles. We did not give permission for the neighbour's black tiles to be installed on our roof (which has red tiles) or give permission for the hip to be cemented to our felted roof. We have asked the roofer 4 times to remove the hip (carefully so it does not tear the felt) but he refuses as he says it will cost him money. We are in contact with the Guild of Master Craftsman to see if they could help but the roofer is not answering their letters. Yesterday, we received back the recorded delivery letter we sent to the roofers marked 'Refused'. Who is ultimately liable to restore our roof back to how it was before the roofer came onto our property and interfered with our tiles and flat roof? We have had a survey by an independent roofer who says that not only is the installation wrong and on our property but if the hip has to be removed it will would/could tear the felt on our new roof.

Are you a tradesperson and able to answer this question?

This is completely wrong, first of all before any work was started he should have approached you and explained to you what he was doing and how he was going to do it, then once he had your approval carried out the work. Surely as well your neighbours are answerable as well? I would make sure you name and shame the roofer who has done the work as there are so many cowboys in this world giving us a bad name. Good luck Aaron M Baldry AMB ROOFING SERVICES

Check your 'buildings insurance' policy. If you have legal cover they may be able to assist - give them a call - nothing ventured nothing gained. Since your neighbour and his roofer were subject to the same contract, then your neighbour is also liable for the works carried out. Because you dd not give permission then there is ultimately liability under the law of tort - negligence and trespass. Put everything in writing and keep records of all calls / discussions - you may need to obtain costs to carry out repairs required and submit through small claims.

Hi I’m a fully qualified roofer they should not have worked on ur roof at all. They don’t have permission. End of. Call them to come back and fix it whether it costs money or not, that's not ur worry- it’s theres. A trader can not upset or work on a neighbour's roof
