move boundary line to run fence behind a tree

We are about to have some fencing done. There is a large tree on our boundary and we want to run the fence behind the tree, possibly in a dog-leg rather than to either side of the tree. This would involve shifting our boundary line slightly. Our garden backs to open scrubland, occasionally used as a tip, once allotments. Can we do this?

Hi, if it waste ground and not use a lot should be ok, if they decide to buid on it in the future or get any complates you can always move it, good luck rigsby.

I would tread very carefully, by law this is not your land, never assume it will go unnoticed, all it needs is the environmental team down there perhaps removing the fly tipped waste and your boundary gets noticed, it could be very expensive...
