1. Introduction

1.1 At MyBuilder, we recognise and respect the importance of protecting the privacy of our tradespeople.

1.2 This Privacy Policy describes how MyBuilder Limited (“we”, “our” or “us”) collects and processes personal information about you as a tradesperson through using our Service, www.mybuilder.com and all our other websites, telephone communications, mobile apps and software. “Service” means any service that is provided by MyBuilder to you. This includes but is not limited to provision of contact details, information about jobs, industry information and other products. The Services may be provided through the website, telephone or by any other electronic means. “Personal information” is information, or a combination of pieces of information, that could reasonably allow you, as an individual, to be identified.

3.2 We also may collect information about you from homeowners registered on our site through the reviews they provide or through other individuals you provide by way of references for verification by us. It is your responsibility to tell the referees provided on the references that they may be contacted by us and ensure consent for such contact is received from the referees.

3.3 We may be required by law to collect certain personal information about you or as a consequence of any contractual relationship we have with you. Failure to provide this information may prevent or delay the fulfilment of our obligations to you and other regulatory bodies.

4.1 Information we collect directly from you

(a) personal and contact details e.g. name, date of birth; telephone number, email address, postal address, billing address;

(b) account details e.g. username and password;

(c) communications e.g. when you participate in message boards or forums, participate in polls or surveys, respond to a review, message a homeowner, contact us with a question, comment or request or when you answer a post from a homeowner on Ask a Tradesperson;

(d) financial details e.g. your bank account details;

(e) ID documents e.g. drivers’ licence or passport;

(f) recordings of calls you make to our customer service agents for training quality purposes;

(g) your photograph;

(h) proof of ability e.g. skill-based questionnaires, Gas Safe registration, plumbing qualifications, evidence of work done etc.

4.2 Information we collect about your use of the Services

4.2.1 Below are examples of the other categories of information that we may collect:

(a) technical information collected from your computer or mobile device e.g. your IP address, browser type, operating system;

(b) information about your usage of our websites, Services, and apps e.g. the pages you visit when using the Services, the search terms you enter on the Services, how often you use the Services, the pages you access before and after accessing the Services, our understanding of your interests as a result of your use of the Services and whether you are a regular or occasional user of the Services.

(f) technical information about the delivery of emails, SMS, and push notifications from other sources such as Google Analytics and Amazon Web Services;

(g) details of work being completed by you.

5. How we use your personal information and the basis on which we use it

We may also contact you to ask you for feedback on our Services for internal research purposes. It is in our legitimate interest that we are able to provide you with appropriate and personalised responses and provide you with notices about our Services as well as conduct research into our Services for business research and development.
Marketing We may use your personal information to create a profile about you, place you into marketing segments in order to better understand your preferences and to personalise the marketing messages we send to you. It is in our legitimate interest to provide you with more relevant and interesting advertising messages.
We use targeted advertising tools to show you advertisements that are relevant to your interests. These tools may collect information about your browsing behaviour and use it to serve advertisements that are more likely to be of interest to you.
a) Where you receive newsletters or offers from us, this is on the basis of our legitimate interests and you may opt out at any time.
b) Where you receive targeted advertisements, this is on the basis of our legitimate interest to promote our Services that are relevant to your interests. You may set advertisement preferences on the relevant social media companies’ settings
Running and protecting our business We analyse your personal information to exercise our legal rights where it is necessary to do so, for example, to detect, prevent and respond to fraudulent activity and claims e.g. fake feedback, inappropriate communications, creation of new accounts for banned users, intellectual property infringement claims, or violations of law or our Terms and Conditions. It is in our legitimate interest to operate our business in a safe and lawful way and protect it from fraudulent or other unlawful activity.
Complying with our obligations We may process your personal information to carry out fraud prevention checks or comply with other legal or regulatory requirements, where this is explicitly required by law. It is necessary to comply with a legal obligation.
Customising your experience When you use our Services, we may use your personal information to improve your experience with MyBuilder. It is in our legitimate interests to provide and develop our Services with relevant content for you.

6.1 We may anonymise your personal information in such a way that you may not reasonably be re-identified by us or any other company. We may use this anonymised information for any other purpose.

7. How and when we share your personal information

7.1 We may share your personal information with third parties under the following circumstances:

7.1.1 When you are chosen, shortlisted or hired: we will share the name and phone number (and if applicable, the address of the job) of the homeowner with you; and your name, phone number, and profile page with the homeowner.

7.1.2 If there is a dispute between a homeowner and you: in the event of a dispute, we will share your address, email address, and telephone number with the homeowner who posted the job at their request. At our absolute discretion, we may share other relevant information where we are legally permitted to do so.

7.1.3 Search engines: Every Trade Account has a public profile page which is displayed in search results to help generate interest from potential customers; these profiles can also show on our directories and Ask a Tradesperson page. The information we display on these pages includes but is not limited to: username, company name, trading name, profile picture, working area, feedback, company information, trade services, photographs, and other information that you may provide us with.

7.1.4 Service providers and business partners:

(a) We may share your personal information with our service providers and business partners that perform marketing services, fraud prevention, and other business operations for us for the purposes set forth above. For example, we may partner with companies to process secure payments (such as Stripe, a payment option for bank transfers), collect debts, optimise services, supply online behavioural advertising, send newsletters and marketing messages, send support emails, communicate via messaging services, and analyse information.

(b) We may also share your information with third-party advertising partners such as TikTok, Google, and Meta to show you advertisements that are relevant to your interests. Such information may include your e-mail address, name, and telephone number. These advertising partners have their own privacy notices, which may differ from ours. We encourage you to review the privacy notices of these partners before providing any information to them.

7.1.5 Group companies:
MyBuilder Limited is owned by IAC Inc., and we work closely with other businesses and companies that fall under the IAC Inc. family. We may share certain information about your usage of the site with IAC Inc. and other IAC Inc. companies for the purposes of security, optimisation of products and services, and internal reporting.

7.1.6 Where required by law:
We may share your personal information with law enforcement agencies, courts, other government authorities, or other third parties where we believe necessary to comply with a legal or regulatory obligation, or otherwise to protect our rights or the rights of any third party.

7.1.7 In the context of a transaction:

8.1 We implement physical, technical, and organisational security measures designed to safeguard the personal information we process through our Services. When deciding how long to keep your personal information after our relationship with you has ended, we take into account our legal obligations e.g. UK tax legislation requires us to hold information for a minimum of 6 years. We may also retain records to investigate or defend against potential legal claims. We will also retain information on all Tradespeople to help us prevent fraudulent activity e.g. trying to open multiple accounts.

9. International data transfer

9.1 Your personal information may be transferred to, stored, and processed in a country that is not regarded as providing the same level of protection for personal information as the UK, and may be available to the government of those countries under a lawful order made in those countries.

9.2 We have put in place appropriate safeguards (such as regulator approved standard contractual terms) in accordance with applicable legal requirements to provide adequate protection for your personal information. 10. Your rights over your personal information

10.1 You may, in certain circumstances, have rights regarding the personal information we hold about you. These may include the rights to access, correct, delete, restrict or object to our use of, or processing of your personal information. You may request to receive a portable copy in a usable electronic format of your personal information.

Where you have provided your consent to any use of your personal information, you can withdraw this consent at any time.

7.1.2 When you “Ask a Tradesperson” or post a review: your name will be shown publicly unless you choose to make it anonymous.

7.1.3 When a Tradesperson is shortlisted, accepted or hired: we will share your name, email address and phone number (and, if applicable, the address of the job) with the Tradesperson; and the name and phone number of the Tradesperson with you.

7.1.4 Service providers and business partners:

a) We may share your personal information with our service providers and business partners that perform marketing services, fraud prevention, and other business operations for us.
