Builders dispute

Anonymous user 24 February 2024 - 7.47 AM

Was wondering what happens when a builder terminates the contract. They went over the contract date and now they are trying to change the lay out of the design, they are making all excuses that they can't install a steel rod triangular window ,they are demanding the outstanding balance which is supposed to get paid at the end of all works. They actually got paid for the window in their quote. So was wondering do I need to go down the legal route.

Are you a tradesperson and able to answer this question?

A contract is a contract it’s there to protect both parties if the contract has been broken then you should seek legal advise do not be bullied Good luck. Will Griffiths.

Yes I’m afraid, so if you had a written contract with stage payments, then you should’ve stuck to it, they have no legal right to be paid for any work they haven’t done if they can’t or won’t finish the job, then the money can be used to get other builders in to finish the work.

If its in black and white and terms were agreed on and signed before work started then its on the contractor to abide with those terms. If you have had those terms agreed upon changed during the term of the the job then its upon you both to come to an arrangement

Before going down the legal route. Have a meeting with the builder with an independent arbitrator. This would take out the stress and look at both sides. It will be difficult to carry on with the builder, but it is the correct path.
