Fencing

Do I need planning permission to add a fence at the side of my property that meets the pavement?

Anonymous user 25 February 2024 - 2.30 PM

My house is at the turning point of a cul-de-sac, with a shared drive. Between the side of my house and my half of the drive there is a path to the back gate, and a 6ft wide flower bed. I would like to put a 6ft fence around the drive side of the flower bed, across the front of the flower bed that sits against the pavement, and move my back gate forward to make the new area secure. The flower bed is only parallel with my drive, and sits some 5ft behind the front line of the house. There would be no impact to visibility for anyone using the road or turning as it is set back from the road. I'm not sure if the fact that there is 6ft at the front of the flower bed that meets a pavement means I can't have tall fencing? Thanks for the responses - seemed it’s not clear cut. Having spoken with the LPA, it seems I need planning permission for the 6ft part of the flower bed that joins the pavement - for any height fencing. Otherwise I would need to drop it back by 2 metres, which defeats the object of doing it. It should be a very straight forwards approval, in that the 6ft fence will not obstruct any visibility for the people using the turning area, as the fence is set back from it by around 5-6ft, there are other 6ft fences that join onto the pavement elsewhere on the estate (all back garden fences). Just a pain I have to fork out the money cos I have a neighbour who will complain just for the sake of complaining.

Are you a tradesperson and able to answer this question?

Hi ! You don't need planning to built a 6FT fence, now it depends on the area where you live and how other fences in the neighbors are built, if your neighbors have a 4FT fence, it would be breaking some rules for you to have a 6FT fence. I installed without planning to several clients who were put in your situation, and we decided togheter with the client to keep the same height at the fences of the neighbors on that street . thank you !

You would be best of asking the local authority to cover yourself you don’t want to put it up and be told it has to come down

fences that meet the public highway is a tricky subject to answer without speaking to your local authority, commonly you can have 2m to the rear and side of your property, with regards to your drive normally its 1m if your fence/wall blocks a potential view of someone driving down the street my answer would be a max of 1m, A quick chat with your local authority will put you straight
