Builder not completing work

Started a single storey extension August 2021, original had to be pulled down and restarted by another team of builders as it was not fit for purpose. which now the brickwork is done and the roof. Original contract was to be finished by December 21. The project manager/ building company director gave us new schedule due to finish mid June, still not done as he hasn’t got cash to finish it or provide materials for the builders. Keeps making promises, never materialises. We have paid out most of the money. Is it worth suing him as it’s evident he has no money anyway?

Hi Kate,
We always issue a contract that is fully explained before both parties sign it, this also includes a payment schedule. I always arrange a fortnightly/monthly meeting with the client to run through progress/delays/variations/costs it keeps everyone up to speed.
Sound like the guys have run out of money! I would ask for an informal meeting to go through what is happening "be honest and ask what you need to know"
