NEW FENCE ERECTED BY NEIGHBOUR

Anonymous user 03/03/2024 - 3.18 PM

Hi everyone, My neighbour pushed a note through my door at 23:30 on a Sunday night telling me a fencer was starting work the next morning. I went round there and then and told her she couldn't touch the fence to her right (my left) as it was mine in the deeds to the property. She had not told us anything about what type of fence she was proposing to have erected. We tried to compromise by saying she could take our existing fence down and replace it with her one but only if the good side panels were facing towards our garden (as they already do from build). She never bothered to reply and instead has erected a 6ft 2inch cheap horrible fence of white concrete blocks with the fencing in between. As our gardens have a very large slope from house to fence at the bottom of the garden we now stare at fencing that is 4 different levels due to the slope including one that is actually a triangle shape at the top. Although there is nothing touching nor is it attached to our wall (original one still is) there is now a gap of 6inches between the fences, this looks all the more of an eyesore as our fence is only 3ft high. What can be done and has she broken any rules? Thank you everyone.

Are you a tradesperson and able to answer this question?

unfortunately as long as she has not crossed your border you have a very limited response but if your fence is lower than hers and funds permitting how about a small timber panel on top so at least you have an equal level , best of luck Alex Vision

She has caused criminal damage by removing your fence to the left of your house

If she's not removed your fence there's not a great deal you can do. However like the first trade said funds permitting I would replace the fencing at 3 ft high with a 6ft 6inch fence. 6ft 6inch is the maximum legal height without having to ask for permission. This should cover the mess she has made and also give you more privacy

If it’s on the assigned boundary and it’s your fence it’s illegal for them to do this simple as.. it would be classed as “destruction of property” and although you could get police involved they would most likely push it off as a civil matter (court) it should have been made clear (in writing off the fitter if poss) what was going up before hand. If I’m doing a job for a customer without written authorisation I will only put a fence up in front of it and leave the existing in place (this is legal)
