Urgent : height of flat roof

*** I already have planning permission****
I am doing an L shaped side + rear extension. My garden is at almost 1m below the main house and all the extension is going to have same level as main house. since max permitted height of flat roof is 3m, that leaves me with only 2m as height for rear side (garden) . my builder is saying solution is too raise level of garden and thus ave more roof space at rear while my architect thinks height should be measured from front of house, so we can go upto 3m from ven from raised floor level of rear extension.

Any idea who is correct and if what is the solution approach please?

Why not speak to the Planning department and see what would be permissible as a non material variation.

If they have given Planning Permission then you can build what was submitted :-) If what was submitted can be built, there are no awkward conditions on the planning permission and your "architect's" is only valid they they are actually an architect, ie registered with ARB :-) If not registered with ARB they are not an architect.
