How close can a drive be built?

The neighbour is building an extension to his drive. He dug out the ground some time ago and dug out a few inches under my fence. Is it allowed to lay a drive right up to neighbours garden or should he leave a channel or gap? .

If it's your fence and that is the boundary, then that's as far as your neighbour
Can go with his drive.
