Extending Boundary in my garden

My deeds on Land Registry show the Red Line boundary as original plot and the side garden adjacent. The side garden is quite large and since 2004 has had a 3ft Iron Fence in place meaning that the garden is not accessible to the public. We are solely responsible for the maintenance of this area as it is our property and not accessible by any contractors that may cut the grass or maintain other common areas on our estate. Am I able to extend my garden to incorporate this land into my back garden? Currently it is only accessible via the front garden.

If you feel you have maintained land outside of your official title boundary you may be able to apply for adverse possession of land. The minimum period is 7 years, however this must be evidenced in some way. If you are not building, the planning dept. will not be concerned as this becomes a civil matter rather that a matter under the Town & Country Planning Act 1990. I would advise speaking to a solicitor who specialises in Land Disputes or indeed a party wall surveyor as mentioned above.

Hi. If its your land and your fence and what you intend to do is within your rights under permitted development then no problem, however if its been a public path then you might have to have a chat with your planning department or a local boundary and party wall surveyor. Speak soon Chris
