Damp Proofing

Neighbour has rising damp on a party wall

My terraced property is higher than my neighbours and we have a single storey party wall between the properties, this extends out into her garden but remains as the wall to my utility room... she is experiencing damp inside and out on the wall I'm guessing because she is below the ground level of my house, the damp proof course is showing approx a metre from the bottom on her side of the wall and it has not been breached in that all of the damp issues are below it... she is adamant the wall belongs to my house therefore I should pay to fix the issues.. is she right? Is it my responsibility? Even though I have no damp problem, if it is down to me then I'm happy to pay out but not if it is down to the neighbour to fix... please help... thank you in advance.... I should mention these are ex local authority homes and it is a single brick wall not cavity.I don’t need a damp course treatment as I have no damp in my home

your house must have had a damp proof job done which is take all plaster off 1.2 meter s high replaster in sand and cement and water proofer all terraced house s need this doing as damp course fails

its basically a party wall shared by both houses, it is most likely caused by penetrating dampness, you don't say if its a cavity or solid brick building as for blame thats the million dollar question in theory it could be argued its the builder for building to high, or its planning/ building regs for allowing & passing a building with foreseeable future issues this could keep a lawyer busy for years , was their a party wall agreement in force at the time of the build, was it signed of by building /planning, its definitely you building that is causing the issues but its really if it was foreseeable where all reasonable steps taken and could this have been avoided also of course how much you want to remain friends with your neighbour the only solution may be tanking this section of wall. whether you or you neighbour pays is really up to you good luck alex
