retaining wall/driveway colapse

my next door neighbours driveway is colapsing in to my drive.it was propped up by 2 inch flags and there fence screwed threw the flags to support the fence.over time posts have loosened flags leading to colapsing drive.has hes 3/4foot above me and its his new extension and driveway it supports who responsibilty is it eo maintain.online it says whos ever land is supported and benifiting from must.is this correct????????

It's he's responsibility to maintain he's own drive , he needs a retaining wall built from blocks and bricks .
